CANADA VACATIONS CONSTITUTES A BINDING AGREEMENT SIGNIFYING YOUR ACCEPTANCE OF, AND YOUR
AGREEMENT TO FOLLOW, THESE TERMS & CONDITIONS, AND TO BE BOUND BY THEM.
NOTE:
Air Canada Vacations is a wholesale tour operator and does not own, manage, control or operate any aircraft, ground transportation, hotel, resort, cruise ship, restaurant or other suppliers associated with the assembly of your package.
Insurance
Air Canada Vacations strongly recommends the purchase of an all-inclusive holiday insurance package (trip cancellation & interruption & classic medical travel insurance) offered by RBC Insurance or other sufficient traveller's insurance. Government health plans have severely cut back their coverage of out-of-country medical care. All travellers, foreign and Cubans living abroad must have a medical insurance policy when travelling to Cuba.

Refunds
No reimbursements or refunds will be issued for unused travel services or any component of the package after departure.
Refunds are not granted for bookings cancelled due to inclement weather or illness; these must be claimed through your travel insurance. No guarantee is provided or warranted that any refund will be available. No refund will be granted if a sale price is advertised after a reservation is confirmed.
Reporting of Incidents
Regardless of Air Canada Vacations liability, any incidents including injuries, service cancellation or problem, or dissatisfaction must be reported to your destination representative or Customer Care (telephone number and / or email address with travel documents) during the event or as soon as possible, to allow Air Canada Vacations an opportunity to provide assistance.
Validity of Rates
Prices apply to specific dates as per the group contract. Air Canada Vacations endeavours to deliver the vacation package you have selected. If the price increased following the imposition of a surcharge on fuel by the carrier or an increase in the exchange rate, insofar as the exchange rate applicable before the date on which the services are provided has increased by more than 5% since the date on which the contract was entered into; and/or if the increase, without taking into account any increase in the provincial sales tax or Canada's goods and services tax, rising taxes, royalties or authorized charges by a competent public authority, is equal to or greater than 7% of the price of services, you may choose between a full and
immediate reimbursement of the services or the provision of similar services. Reimbursements are processed by Air Canada Vacations within 14 days of receipt of your written request for cancellation.
Currency
All rates are quoted in Canadian funds, unless otherwise indicated based on exchange rates, fuel cost, taxes, fees, charges and surcharges (including service charges imposed by Air Canada Vacations) as confirmed at time of booking.
INCLUSIONS AND EXCLUSIONS
Prices DO Include:
Selected combination of flights, accommodation, airport-hotel transfers at destination, applicable taxes, fees, charges and surcharges (including service charges imposed by Air Canada Vacations) and any other inclusions as specified for product selected as per the resort description in this site aircanadavacations.com.
Prices DO NOT Include:
Most vacation packages are subject to extra charges above those reflected in the price for each package. For example, resort fees, any supplementary services purchased at destination (meals, drinks, cleaning, items listed in the facilities description etc.) in addition to any costs incurred en route to and/or from the destination, meals and/or alcoholic beverages (unless specified), local excursions at destination, telephone calls, tips, laundry, items of a personal nature and/ or personal services not specified as being included in association with a selected product as per the resort description in this site aircanadavacations.com, are not included in Air Canada Vacations package prices.Rates do not include certain departure taxes, which must be paid in cash only when departing from certain countries, as follows: approx. 25 Cuban Convertible Pesos per person (Cuba), approx. $7.50 USD per person (Curaçao) and approx. $26 USD per person (Costa Rica).
For Quebec residents only: prices do not include the client contribution to the Indemnity Fund amounting to $2.00 per $1000 of travel services purchased, the amount of which is your retail travel agent's responsibility to collect.
If We Modify Your Booking
Sometimes, reserved accommodations may no longer be available for reasons such as unexpected maintenance or hotel overbooking. In such cases, substitute accommodation of equal or greater quality will be provided. If, after confirmation, Air Canada Vacations makes a hotel change or other changes to your travel arrangements such as:
• change of destination;• change of departure or return by more than 24 hours;• change of accommodation standards;
• change of the routing requiring additional travel identification or documentation without sufficient time to obtain this
documentation before departure; then Air Canada Vacations will contact you or your travel agent at the earliest convenience
upon receipt of notification from the concerned supplier prior to your departure. In this case, Air Canada Vacations offers the following options:
a. Acceptance of the change as offered;
b. Selection of an alternate package with Air Canada Vacations, based on availability. Any price differential resulting from substitution with a lower-priced alternative will be refunded. Customers are responsible for payment of any difference in price based on substitution of a higher priced alternative of their choice;
c. Cancellation of your vacation with a full refund of the price paid to Air Canada Vacations.
Promotions:
Most promotions for individual bookings such as (but not limited to) resort credit may not be available to Group bookings .
LIABILITY
Liability of Suppliers
Air Canada Vacations makes arrangements with third-party suppliers who provide travel services such as flights, cruises, hotels, airport-hotel transfers, sightseeing, car rentals or other activities included in your package. Air Canada Vacations makes every effort to deal with the most reputable suppliers, we are not responsible for their acts and omissions and for acts and omissions of their respective employees, representatives or agents.
Excursions
Customers may choose to participate in excursions, optional tours or activities that may be offered for an additional fee by Air Canada Vacations on behalf of local suppliers at destinations. Any written or oral contract is considered to be between the customer and the supplier. Some excursions may have a risk of personal injury, loss or damage. Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising from a customer's participation.
Airline
Travel services are subject to conditions imposed by law and by third-party suppliers. As such, their liability is limited by their respective tariffs, conditions of carriage as well as international conventions and arrangements. Conditions of Carriage apply to flights bound to and from your destination, some of which limit or exclude liability. For air carrier liability and options available to you regarding loss, damage or delay of your baggage, consult aircanada.com and submit any claims directly to Air Canada or Air Canada rouge. Air Canada Vacations does not assume any responsibility for schedule changes made by the airline, or any additional costs (accommodation, meals, etc.) incurred due to any flight delays or missed connections.

Liability of Air Canada Vacations
Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising out of personal injury, accident or death, loss, damage, delay of baggage or other property, or delay, inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from any of the following:
• The act of omission of any third party including suppliers other than Air Canada Vacations or its employees;
• Sickness, theft, labour dispute, mechanical breakdown, quarantine, government actions, weather, or any other cause
beyond our direct control;
• Your failure to obtain the documentation required for your trip such as passports, visas, and certificates (in which case you are not entitled to any refund);
• Your failure to follow instructions including but not limited to airport departure times, baggage handling, and check-in / checkout times;
• Cancellation or change for any reason in the travel services offered. We reserve the right to cancel or substitute travel services with a comparable alternative at our discretion, and Air Canada Vacations will advise you within a reasonable amount of time prior to departure of any such a cancelation or change. If we must cancel your booking entirely, Air Canada Vacations' liability will be limited to a refund of all monies paid;
• A full refund, however, will not be granted where cancellation of travel must be made by Air Canada Vacations for any situations which are unusual and/or unforeseeable, i.e., any force majeure including (but not limited to) weather conditions such as inundation, any type of storm, hurricane, twister or similar, fire, seismic activity, nuclear disasters, strikes, riots or civil conflicts, acts of war, terrorist actions, any public health emergencies or health risks, government actions, supplier bankruptcies and any other events beyond Air Canada Vacations' control.
Hurricane season in the North Atlantic is generally between June 1 and November 30. Air Canada Vacations is not liable for the costs or other consequences that arise out of or result from any inclement weather conditions at any time and where Air Canada Vacations' contractual obligations with its suppliers does not allow for reimbursement of the sums paid to the supplier on behalf of the customer.
All flights are operated by Air Canada, Air Canada rouge or Air Canada Express (operated by Jazz Aviation LP), unless otherwise specified. Air Canada Vacations reserves the right to decline any passenger at any time.
Photographs displayed on ACV’s website and brochures are representational only, and not a guarantee that everything is exactly as depicted upon arrival at destination. For hotels that are indicated as being projects at time of posting in this site, Air Canada Vacations assumes no liability whatsoever as to any difference between the artist rendition or the listed features or description and the actual state of the hotel at the time of booking. Air Canada Vacations will do its best to monitor the construction and readiness; it does not have control over this. Please consult aircanadavacations.com for the update of the hotel. Should the hotel not be ready at the time of the booking, Air Canada Vacations will offer you a similar alternative hotel or will provide you with a full refund.
Other important information:
Living standards and practices at the destination and the standards and conditions with respect to the provision of utilities, services, religion, sanitary conditions, local practices, political system and accommodation may differ from those found in Canada.
Airport check-in
It is recommended that customers present themselves at the airport counter of the airline indicated on their voucher 3 hours prior to departure, and follow the check-in and boarding gate deadlines listed on www.aircanada.com. Air Canada representatives are available to assist you, or you may contact an Air Canada Vacations representative at 1-800-296-3408.
Failure to check-in and board on time may result in the cancelation of a customer's reservation with no right of recourse.
Food, Water and Beverages
Change of routine, sun and / or food, water and beverages may be very different in other countries and may lead to health issues or illness. Customers are encouraged to take all necessary precautions. Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising from these conditions and resulting health issues. Water interruptions/power outages may be experienced at times.
Social and Sports Activities
Many resorts include social activities, organized sports, and use of sports equipments as part of their services. These amenities are subject to change or cancellation at any time without notice. Some activities may involve risks.
Insects
Insects may be found inside and outside the hotel no matter the hotel chosen as part of the vacation package. Customers are encouraged to take all necessary precautions.
Holidays, School Breaks, Elections and Conventions
Availability of some services and amenities may be limited during certain periods. These periods may include but are not limited to school breaks, spring breaks, religious holidays, elections and conventions. These periods vary by country and are controlled by local or particular authorities. Air Canada Vacations assumes no responsibility for inconveniences customers may experienced when travelling during one of these periods.
Room allocation
The hotel or resort is responsible for room allocation in accordance with the category reserved. Air Canada Vacations assumes no responsibility as to location, décor, furnishing or type of bed in the room that may vary based on the room's location on the hotel property. If the customer would like to change room, the Air Canada Vacations representative at destination can assist. Room changes are subject to availability and additional fees may apply.
Check-in and checkout conditions
Hotel check-in is generally between noon and 3 p.m. Hotel checkout times may vary depending on the property but generally customers must vacate the room by 11 a.m. For passengers with late flights, every effort will be made to provide a hospitality room, however, this cannot be guaranteed, particularly during high season.
Customers will only have access to meals and drinks included in their package between the time they check-in and the time they checkout.
CUSTOMER RESPONSIBILITY
Special Needs
Any particular requirements for passengers with special needs must be requested at time of booking. Some circumstances and medical conditions require that customers provide advance notice and receive medical approval for air travel (for more information, visit www.aircanada.com). Adapted transport for transfer at destination is at extra cost when available. Certain activities at the hotels may be inaccessible to persons of reduced mobility.
Statement to the Travel Agent
Customers must inform their travel agents of their intentions, expectations and needs before their travel reservations are completed.
Medication
It is the customers' responsibility to have all necessary medications and to carry them in their hand luggage at all times and to refer to aircanada.com for required policy to transport prescribed medication. It is the customers' responsibility to ensure that they are fit to travel, and that they have consulted a qualified medical professional.
Pregnancy
You are required to disclose this to Air Canada Vacations at time of booking. Any woman with a normal pregnancy and no previous history of premature labour may travel up to and including her 36th week on Air Canada, Air Canada Express (operated by Jazz Aviation LP), Air Canada rouge and Air Canada coded flights operated by Tier 3 carriers.
Sports and Activities
Information regarding sports and activities in this site is for information purposes only and is not meant to incite participation. Air Canada Vacations assumes no responsibility for any accident, damage, cost or expense arising from participation.

Baggage claims
Please note that for baggage claims, written notice to the carrier must be made within 7 days of the receipt of checked baggage in the case of damage, and, in the case of delay, within 21 days from the date on which the baggage is placed at the disposal of the passenger. immediate reimbursement of the services or the provision of similar services.
